  • Seven-Figure Verdict for Child Tragically Injured by Inappropriate Delivery This baby had several risk factors that would have made it a candidate for a Caesarian section: breech presentation, low amniotic fluid, and possible intrauterine growth restriction. Nevertheless, the baby was delivered vaginally, with the aggressive use of forceps, and suffered numerous severe injuries. The cord was compressed limiting blood flow to the child.  This situation was not handled quickly or in accordance with the standard of care–as a result the baby developed anoxic brain injury, hypoxic ischemic encephalopathy, an intracranial hemorrhage, cerebral edema, seizure disorder, cortical blindness, hearing loss, and other brain injuries. Kolsby Gordon attorneys achieved a seven-figure jury verdict.
  • Six-Figure Verdict for Child Who Developed Erb’s Palsy as a Result of Improper Delivery During delivery, there are several approved procedures to cope with what is known as “shoulder dystocia.” Unfortunately, the doctor in this case did not use those procedures, but instead applied excessive pressure to baby as she was being delivered, permanently injuring the arm and shoulder of the baby and causing a condition known as Erb’s palsy. As a result, the child has permanent neurological disabilities.  She will require years of physical and occupational therapy as well as future surgeries. Kolsby Gordon attorneys made their case before a jury and helped the child’s family achieve a six-figure verdict.
  • Our Firm’s Involvement Representing a Child with Birth Injuries from Low Amniotic Fluids A few days before her due date, a pregnant woman arrived at the hospital complaining of, among other things, a loss of fluid. She was told that her amniotic fluid levels were normal and she was discharged home. The next day she returned to the hospital with contractions and an ultrasound revealed extremely low amniotic fluid levels. When her baby was delivered, he had anoxic brain damage and hypoxia, and he suffered from seizures. Kolsby Gordon attorneys obtained a seven figure settlement on behalf of the clients.
